Kevin's Dismissal - Case Study Example Davis' company rules define such conduct as gross misconduct with the result that the employee in question is subject to summary dismissal. The first issue is therefore whether or not such a standard and rule by Davis is fair and reasonable. Having regard to onerous duty placed upon the employee by virtue of Section 2 of the Health and Safety at Work Act 1974, such a standard and rule is fair and reasonable in the circumstances. Section 2(2) provides as follows: "...the matters to which that duty extends include, in particular - the provision and maintenance of plant and systems of work that are, so far as is reasonably practicable, safe and without risks to health; the provision of such information, instruction, training and supervision as is necessary to ensure, so employees that is, so far as is reasonably practicable, safe, without risks to health, and adequate as regards facilities and arrangements for their welfare at work."1 This statutory duty on the part of the employer was preceded by a common law duty to provide for the health and safety of all employees.2 The House of Lords held in Wilsons & Clyde Coal Co. Ltd v English [1937] 3 All ER 628 that the duty was "personal to the employer."3 The duty to provide a safe place of work is for the safety of all employees and the nature of both the statutory and common law duty is such that it gives rise to what might be a strict liability. Having regard to the consequences of a breach of such duty it is not unfair nor is it unreasonable for Davis to have in place rules that require a designated number of employees to operate its machinery. It is assumed that should the machinery be under operated it could render the machinery unsafe with the result that Davis is liable for any resulting harm to its employees. Moreover in 1993 the Management of Health and Safety at Work Regulations 1992 were implemented and fortified the nature of the employer's duty to provide a safe and healthy workplace. Upon a broad interpretation of the 1992 Management of Health and Safety at Work Regulations that duty is unquestionably a strict duty. The 1992 regulations imposes upon the employer a continuing duty to ensure that all health risks are eliminated or at the very least minimized. This continuing duty is necessary: "...for the purpose of identifying the measures he needs to take to comply with the requirements and prohibitions imposed on him by or under the relevant statutory provisions."4 It therefore follows that the rule implemented by Davis to ensure that a specific number of employees operate machinery is fair and reasonable having regard to the statutory and common law duty to guard against risks to its employee's safety. Certainly Davis is entitled to take steps to ensure that the risk of harm associated with under manning the machinery is alleviated. In Walker v Northumberland County Council [1995] IRLR 35 it was held that once an employer becomes aware of the risk to employees' health, the employer is duty bound to take steps to alleviate that risk.5 Obviously, Davis has decided to alleviate the risk of harm by designating wilful failure to report to the

Dickens already had ideas of how to use these types of experiences in a novel. Dickens used Scrooge as the main character to show that wealthy people always have a responsibility to help those less fortunate. He clearly shows this view at the end of the novel where he gives a young boy money to buy a turkey for the Crachit family. The family isn’t the richest but has a really warm heart. Crachit tries showing Scrooge that life is not all about money and also that he should try to move on and forget about Bella. Scrooge had a really bad experience when Bella marries someone else because she told him that he cares about money more than her. Scrooge somehow had to overcome this tragic event in his life and since then he has not been able to celebrate a successful eve without thinking of her for even a moment. Scrooges clerk Bob Crachit is a middle–aged man who has six children. Ebenezer is thin and has a slight hunchback, coal grey hair and a wrinkled old face, on which he has reddish eyes, a long pointed nose and thin blue lips as cold as ice. Like his employee Bob is very well dressed. Let’s take a look at Scrooge first, before he got visited by the spirits he was a very stingy person and only cared about his own interests. He couldn’t manage to share his money and was not sensitive to the suffering of others. Ebenezer was even harsh to his employee who never cheated, is reliable, hardworking and had to endure the bad behaviour on him. Bob is satisfied with not owning anything and having no money at all. In my opinion Scrooge turned into a better character and I admire his sudden transformation into a better human being. Bob Crachit’s characteristics are that he is poor, has a big family, young and takes care of his close ones, joyful and nice. The crachit family live in a small cosy home but they don’t have enough money to decorate it with luxuries because the most important thing for them is too have enough money for coal/fire so that they would be warm, however most importantly all they want to happen is for Tiny Tim to be a healthy again. The miraculous transformation that Scrooge has made makes us aware that good change is never too late. Also that money cannot buy happiness you just have to share it with other people to make something good of it.

Many social scientists reject the idea that ‘families can be defined only by blood ties. ’ Discuss. The Oxford Dictionary meaning of family is noun (plural families) 1 [treated as singular or plural] a group consisting of two parents and their children living together as a unit. There are many different ideas about what makes a family, and is this idea of what a family is universal and the children’s perspectives. There is a lot of debate with social scientists about the family. Functionalists say that the term family is a universal institution performing functions for society’s survival. Sociologist Murdock suggest that each family has for functions in order to be classified as a family. They are, a common residence, however there are many cases in which families do not share a common residence for example if a child is at boarding school or a parent is in the armed forces. (Murdock, cited by Gittins, D, p. 2). (Gutman 1976) found that it was common among black slave families in the USA for a husband and wide to live on different plantations and see one another for a few hours once or twice a week. (Edholm 1982 cited by Gittins p. 4) Anthropologists prefer to use the term kinship rather than family, â€Å"the ties which exist between individuals who are seen as related both through birth (descent) and through mating (marriage). † This theory is concerned with the ways in which parentage us assigned, attributed and recognised, descent is traced, relatives are classified, rights are transferred across generations and gr oups are formed. Unlike the functionalist approach the kinship theory stresses the fact that kinship is a social construction and also it emphasises on the variability of kinship depending on how it is defined. There is a debate about whether kinship is biological or social, many of us believe that its biological because of we know who are parents are and they made us so we simply think that kinship is biological but there are cases where children are brought up by parents who they believe to be their biological parents and then find out that they have been adopted and then suffer an identity crises because they do not know who they are anymore. Their own suffering is caused by the ways in which we define kinship in society and there is a clear difference between a ‘biological’ and ‘social’ parents, we see the biological parent as the real parents and that has the strongest bonds with the child, this is a strong western belief. However in other cultures they believe that it is the person who rears the child is defined as the parent regardless who is involved in the reproductive process, for example in some cultures it is common for a child to be raise by a grandparent.
