Kevin's Dismissal - Case Study Example Davis' company rules define such conduct as gross misconduct with the result that the employee in question is subject to summary dismissal. This kind of conduct is considered gross conduct since the employer considers that machinery should be operated by a specific number of employees. The first issue is therefore whether or not such a standard and rule by Davis is fair and reasonable. Having regard to onerous duty placed upon the employee by virtue of Section 2 of the Health and Safety at Work Act 1974, such a standard and rule is fair and reasonable in the circumstances. Section 2(2) provides as follows: "...the matters to which that duty extends include, in particular - the provision and maintenance of plant and systems of work that are, so far as is reasonably practicable, safe and without risks to health; the provision of such information, instruction, training and supervision as is necessary to ensure, so employees that is, so far as is reasonably practicable, safe, without risks to health, and adequate as regards facilities and arrangements for their welfare at work."1 This statutory duty on the part of the employer was preceded by a common law duty to provide for the health and safety of all employees.2 The House of Lords held in Wilsons & Clyde Coal Co. Ltd v English [1937] 3 All ER 628 that the duty was "personal to the employer."3 The duty to provide a safe place of work is for the safety of all employees and the nature of both the statutory and common law duty is such that it gives rise to what might be a strict liability. Having regard to the consequences of a breach of such duty it is not unfair nor is it unreasonable for Davis to have in place rules that require a designated number of employees to operate its machinery. It is assumed that should the machinery be under operated it could render the machinery unsafe with the result that Davis is liable for any resulting harm to its employees. Moreover in 1993 the Management of Health and Safety at Work Regulations 1992 were implemented and fortified the nature of the employer's duty to provide a safe and healthy workplace. Upon a broad interpretation of the 1992 Management of Health and Safety at Work Regulations that duty is unquestionably a strict duty. The 1992 regulations imposes upon the employer a continuing duty to ensure that all health risks are eliminated or at the very least minimized. This continuing duty is necessary: "...for the purpose of identifying the measures he needs to take to comply with the requirements and prohibitions imposed on him by or under the relevant statutory provisions."4 It therefore follows that the rule implemented by Davis to ensure that a specific number of employees operate machinery is fair and reasonable having regard to the statutory and common law duty to guard against risks to its employee's safety. Certainly Davis is entitled to take steps to ensure that the risk of harm associated with under manning the machinery is alleviated. In Walker v Northumberland County Council [1995] IRLR 35 it was held that once an employer becomes aware of the risk to employees' health, the employer is duty bound to take steps to alleviate that risk.5 Obviously, Davis has decided to alleviate the risk of harm by designating wilful failure to report to the

There was a well known prison called the â€Å"The Marshelsea†, it became know in the 19th century around the world through the writing of the English novelist Charles Dickens. His father which was there in 1824 for a debt of ? 40 and 10 shillings however Dickens most traumatic experience was when he was forced to leave school at the young age of 12 to work in a factory instead. Dickens already had ideas of how to use these types of experiences in a novel. Dickens used Scrooge as the main character to show that wealthy people always have a responsibility to help those less fortunate. He clearly shows this view at the end of the novel where he gives a young boy money to buy a turkey for the Crachit family. The family isn’t the richest but has a really warm heart. Crachit tries showing Scrooge that life is not all about money and also that he should try to move on and forget about Bella. Scrooge had a really bad experience when Bella marries someone else because she told him that he cares about money more than her. Scrooge somehow had to overcome this tragic event in his life and since then he has not been able to celebrate a successful eve without thinking of her for even a moment. In much earlier in the novel 3 old men come up to Scrooge asking for money to donate to people for Christmas, however Scrooge is a cold hearted person so instead of donating a few shillings he says â€Å"Bah Humbug. † The main character of â€Å"A Christmas Carol† is Ebenezer Scrooge. He is an elderly man who lives in London, his sister died leaving a son whose name is Fred. In addition to this Ebenezer has no family. He is a very rich banker. Scrooges clerk Bob Crachit is a middle–aged man who has six children. Ebenezer is thin and has a slight hunchback, coal grey hair and a wrinkled old face, on which he has reddish eyes, a long pointed nose and thin blue lips as cold as ice. Like his employee Bob is very well dressed. Let’s take a look at Scrooge first, before he got visited by the spirits he was a very stingy person and only cared about his own interests. He couldn’t manage to share his money and was not sensitive to the suffering of others. Ebenezer was even harsh to his employee who never cheated, is reliable, hardworking and had to endure the bad behaviour on him. Bob is satisfied with not owning anything and having no money at all. In my opinion Scrooge turned into a better character and I admire his sudden transformation into a better human being. Bob Crachit’s characteristics are that he is poor, has a big family, young and takes care of his close ones, joyful and nice. The crachit family live in a small cosy home but they don’t have enough money to decorate it with luxuries because the most important thing for them is too have enough money for coal/fire so that they would be warm, however most importantly all they want to happen is for Tiny Tim to be a healthy again. The miraculous transformation that Scrooge has made makes us aware that good change is never too late. Also that money cannot buy happiness you just have to share it with other people to make something good of it.

Many social scientists reject the idea that ‘families can be defined only by blood ties. ’ Discuss. The Oxford Dictionary meaning of family is noun (plural families) 1 [treated as singular or plural] a group consisting of two parents and their children living together as a unit. There are many different ideas about what makes a family, and is this idea of what a family is universal and the children’s perspectives. There is a lot of debate with social scientists about the family. Functionalists say that the term family is a universal institution performing functions for society’s survival. Sociologist Murdock suggest that each family has for functions in order to be classified as a family. They are, a common residence, however there are many cases in which families do not share a common residence for example if a child is at boarding school or a parent is in the armed forces. (Murdock, cited by Gittins, D, p. 2). (Gutman 1976) found that it was common among black slave families in the USA for a husband and wide to live on different plantations and see one another for a few hours once or twice a week. (Edholm 1982 cited by Gittins p. 4) Anthropologists prefer to use the term kinship rather than family, â€Å"the ties which exist between individuals who are seen as related both through birth (descent) and through mating (marriage). † This theory is concerned with the ways in which parentage us assigned, attributed and recognised, descent is traced, relatives are classified, rights are transferred across generations and gr oups are formed. Unlike the functionalist approach the kinship theory stresses the fact that kinship is a social construction and also it emphasises on the variability of kinship depending on how it is defined. There is a debate about whether kinship is biological or social, many of us believe that its biological because of we know who are parents are and they made us so we simply think that kinship is biological but there are cases where children are brought up by parents who they believe to be their biological parents and then find out that they have been adopted and then suffer an identity crises because they do not know who they are anymore. Their own suffering is caused by the ways in which we define kinship in society and there is a clear difference between a ‘biological’ and ‘social’ parents, we see the biological parent as the real parents and that has the strongest bonds with the child, this is a strong western belief. However in other cultures they believe that it is the person who rears the child is defined as the parent regardless who is involved in the reproductive process, for example in some cultures it is common for a child to be raise by a grandparent. Gender also affects the ways that kinship is constructed and defined, they are both universally present as mothers and children are but the content of them and the meanings ascribed to them is highly variable. Age is also an important fact when it comes to kinship as people grow up the household composition and resources change. All relationships are different and with society changing there has become many different norms of society. Plato and Gettier on Knowledge Essay Plato in one of his most famous earliest dialogue Meno tried to provide a new way of explaining how we humans acquire knowledge. The common notion of the ancient Greeks and even to our times on how we acquire knowledge is the characteristic of knowledge to be taught and learned. Knowledge in a sense is an outside entity that resides outside ourselves. We learn outside of ourselves through our environment or other people that try to teach us. However, the events and flow of discussion in Meno had convinced Plato to provide a new framework that will be able to discuss how we acquire knowledge. Platos basic discussion says that knowledge acquisition is more in fact a matter of recollection rather than learning. We acquire knowledge and ideas from the inside of ourselves and not through the lessons outside ours. Plato rooted this from the belief of the priest and diviners and even philosophers to the immortality of the soul. The soul had existed since time immemorial making it able to know everything it needs to know. Whatever knowledge and ideas had already been embedded on the soul because of immortal existence. However, as the soul transfer from one body to another body because of the mortality of the human body, Plato argued that as the body withers and dies, all the knowledge are forgotten and put into background. From here, Plato would argue for the knowledge acquisition to be a matter of recollection and remembering of the knowledge and ideas already possessed by the soul. Plato believed that whatever we know is a recollected and remembered idea of the souls former existence. This concept was explained by Socrates to Meno with the help of Menos slave. Socrates called the slave and asked some questions regarding geometry and the measurement of some shapes. Socrates tried to ask some questions that direct the slave to answer them rightfully. It is important to note the slave is uneducated in the classical sense. However, through Socrates questions, he managed to enable to direct the slave towards right answers. For Plato, this knowledge can be accessed by examining ourselves and with yourself or someone asking the right questions that will redirect you to the knowledge and ideas inside your soul. After discussing the nature of knowledge and how we can acquire it, Socrates and Meno moved on to discuss to define opinion and its relevance on the affairs of man. The task is simple, to define opinion (true opinion) and to contrast it to knowledge. Primarily, Socrates acknowledged the role of a good opinion in the human affairs. He did not disregard it completely but rather understand its use in some cases. In fact, he acknowledges the inclination of virtuous men to rely on their true opinion to do good things. However, Socrates clearly undermines opinion; even they are good when it is contrasted to knowledge. For Plato, an opinion does not last long and easily withers in contrast to knowledge that has the capability to last eternally. The main difference lies on the presence of a rationality and grounds on knowledge and its absence of an n opinion. He used the example of a statue. He stated that the statue with that is tied in a good foundation will be able to last longer compare to a statue that is not tied. For Socrates, though an opinion can produce the same awe to an observer, it is a natural tendency for humans to ask the question of why and how. This definition of knowledge that is characterized by Plato which is defined as a justified true belief had dominated from the ancient Greeks up to the mid-late 20th century. The general belief that knowledge for it to be referred as knowledge must be able to satisfy three basic characteristics, which is (1) justification (2) truth (3) belief was questioned by Edmund Gettiers paper entitled â€Å"Is Justified True Belief Knowledge? †. Each and every kids has a different level of intelligence so we as teachers need to focus more on those students who are slower than the other students. Now Rousseau said that "every child was born with the same intelligence" and from that quote I would have to disagree. Early in the story, the reader discovers that Mary Maloney is pregnant. This understanding is important to the story on a number of levels. The most basic is that it helps the reader to understand just what it is that her husband is doing by leaving her. This makes the story more ambiguous in morality by making the reader associate with the woman more. In addition, it almost certainly helps keep her from being suspected. The motherly instinct of protection is invoked by this understanding as anyone can understand the  instinct of a mother protecting her child and the fear of execution is vital to making Mary a more positive character. Why Are the Exact Words Patrick Says When Leaving Mary Left Out? In the middle of the conversation between Patrick and Mary, the narration changes for a single paragraph at the very climax of the conversation. Patrick leads into the conversation with the hope she won’t blame him too much. It then says that he told her, though not exactly what, and ends with him saying that he will take care of her. This change in narration is disconcerting and in large part that is the point. This helps the reader to understand the disorientation and detachment of Mary. In addition to this, by not telling the reader exactly what happened, it gives far more power to the reader in the interpretation of her later actions. By not knowing exactly what he said, it lets the reader decide if Mary’s actions in the rest of the story are justified or not. Why Is Patrick’s Profession Important? Patrick is a police detective. This bit of information is vital to the story in a number of ways. As a story in which the reader is supposed to empathize with the murderer, having the victim be a vital and trusted member of society creates even more conflict in the mind. In addition to this, it plays with two basic ideas, that the police will look for a killer more vigorously if an officer is killed, but also that she knows the officers who will investigate the crime. This means that they are more likely to be comfortable with her. Also important is the understanding that Mary is likely to have an escape of being arrested for the crime. As the wife of a police detective, she has almost certainly heard many stories about crimes that he has solved and how he has done it. Finally, this creates many other suspects that could have committed the crime because as a police detective he has many enemies. What Is the Dramatic Irony in â€Å"Lamb to the Slaughter†? There are a couple of moments of dramatic irony in â€Å"Lamb to the Slaughter.† These are cases in which the reader understands more than the characters.  The most clear of these occurs near the end of the story. Mary has called the police and the detectives are in her house. As they are eating the lamb of leg, one of the officers says in relation to the murder weapon that it is â€Å"probably right under our very noses.† This statement is literally true though the officer who says it has no idea what he is saying. What Is the Origin and Meaning of the Title â€Å"Lamb to the Slaughter†? The original use of â€Å"Lamb to the Slaughter† is found in the Bible. This phrase is located in both Jeremiah and Isaiah. It refers to someone who goes innocently and unconcernedly into a dangerous or life threatening situation. In the story â€Å"Lamb to the Slaughter,† it has a number of meanings though. The first clear meaning is one that is a form of dark humor. The lamb in this case is actually a murder weapon. This twists the meaning of lamb to the slaughter into something that is not a metaphor but what actually happens. While the first meaning is clear, the metaphorical use of the statement is still valid and in fact there are two people who go into a situation like lambs to the slaughter. The first of these is the murder victim who, while knowing he is going to do something uncomfortable, has no idea what is going to happen to him. The second though is Mary herself. Leg of Lamb In the story, Mary asks the detectives to eat the leg of lamb she had made for her husband, and even when they turn it down, she insists that they eat this. This insistence is important beyond simply the idea that it is the murder weapon. By having the detectives eat the lamb, they have destroyed the evidence which will make them look stupid even if they later understand. This will discourage them from thinking of it as a weapon. This is the culmination of everything that has happened to this point in the story. The story then pulls back and allows the action to fall. The conflict then begins to rise again as she creates an alibi and brings in the police to catch the murderer. Conflict Just as there are two climax in the story, there are two major conflicts in this story. The first of these conflicts is between Mary and Patrick as Patrick tells his pregnant wife that he is going to leave her. This conflict ends as Mary hits her husband with a frozen leg of lamb and leads into the main conflict of the story. This second conflict is in Mary’s attempt to avoid being caught. She knows that if she is caught she will be executed and fears that her unborn child will be killed as well. This becomes the main conflict of the story and leads to the ultimate resolution of the story in which the detectives eat the evidence of her crime. Rising and Falling Action of the First Climax The action of the story begins to rise as Mary waits for her husband to return in anticipation and continues to increase as it becomes clear that he is preparing to tell her something. It reaches its climax as he explains that he knows that it is a bad time and as he turns his back Mary hits him with the leg of lamb. The falling action for the first of these climaxes is interesting because it has to set up the action for the second half of the story while releasing some of the tension of the first half so that it can be rebuilt. The line which carries the load of this work reads â€Å"All right, she told herself. So I’ve killed him.† This line pulls back the emotions not only of Mary who is telling the story, but also the reader. It is a well created note to the reader that the story is now going to slow down and change. The next paragraph continues this as the woman, who was moments ago out of control, begins to think through the possibilities. She knows that the penalty for murder is execution, but fears for her unborn child and decides that she must protect that child. This then leads into the action beginning to rise again as she focuses on avoiding being captured. Rising and Falling Action of the Second Climax The second climax of â€Å"Lamb to the Slaughter† is the true climax of the entire story. With action that continues to rise as Mary tries to cover up her crime from seconds after she commits it until the moment the detective sees that the oven is still on, the tension spikes. At this moment, Mary is very close to being caught. Yet she is able to think clearly and doesn’t react out of fear. The character herself creates the falling action as she offers the officers something to drink and asks them to help her get rid of the meal that she had been cooking for her husband. This leads not only into the irony of â€Å"Lamb to the Slaughter† as the officers eat the evidence that would have likely put Mary into the electric chair, but also the falling action. The officers have clearly decided that she is the victim of the crime and not the perpetrator as they try to console her. The last of the action disappears as the police officer, while eating the leg of lamb says of the murder weapon, â€Å"Probably right under our very noses,† a literal truth that makes it entirely clear that the police have no idea what happened and are unlikely to discover the truth. In the other room, the last line of the story shows Mary free of tension as she begins to giggle. Resolution Leg of Lamb The resolution of â€Å"Lamb to the Slaughter† is largely implied by the final line. The assumption of the author and reader is that with the murder weapon gone, Mary will not be captured for the crime. Yet none of this is actually said in the story. The story simple ends with the police commenting on the lack of murder weapon and Mary giggling presumably at the irony of them looking for the weapon while eating it. â€Å"Lamb to the Slaughter† is an excellent example of a story that is able to create and release action expertly. It builds up slowly, adding tension on top of tension, until it reaches a crescendo and then releases that, creating a powerful story in the process. Understanding where and how that the author has created that rising and falling action can help to create a greater appreciation for this story and the masterful brush strokes of a  master artist as he created the story. Symbolism: The symbolism Dahl uses to etch the theme of the story begins most obviously with the title of the short story itself, â€Å"Lamb to the Slaughter† and the instrument used by Mary Maloney to kill her husband. Lambs have been used for thousands of years as a symbol of innocence, meekness, and purity. The phrase â€Å"like a lamb to a slaughter† represents something innocent happily making its way towards a negative situation in which it will most likely get hurt. Looking at the story, this phrase could be relevant to either character. Mary Maloney could represent the lamb in the sense that even after her husband told her some seemingly terrible news, she continued on being a gentle and caring wife by trying to make dinner for him as though nothing is wrong. She has apparently been completely blind to these events and has been being led around to this ultimate severance of her marriage like a small fluffy animal to be killed and served with mint jelly. Having the murder weapon just so happen to be a leg of lamb, it is also a symbol of the lamb retaliating against the force attempting to take its innocent and light. Patrick Maloney, however, could also be recognized as being unaware, if not innocent, to a demise. After telling his devoted wife the bad news, he continues on. While he does fight her making him dinner with anger, he is still continuing to stay and talk with her while she essentially goes into a frenzy about her beloved husband. His murder was as easy as that of a lambs, he was completely unaware her retaliation would be fatal. Dahl’s symbolism is interesting and clear and weaves a great layer into the story.
